Dan Rather's Counsel To File Amended Complaint
Tuesday, May 6th, 2008
We've got word for you that Dan
Rather's attorneys at Sonnenschein, Nath & Rosenthal,
are expected to file an amended complaint with Judge Ira Gammerman in the
$70 million lawsuit against CBS Corp. The revised complaint, 51 pages in length, reportedly will
be filed on Wednesday morning.
"Today we served an Amended
Complaint in Mr. Rather's lawsuit against CBS Corporation and Viacom,"
said Martin R. Gold, Lead Counsel for Dan Rather. "The
Amended Complaint responds in the Court's April 10, 2008 ruling that
Mr. Rather's fraud claim did not specify injuries Mr. Rather had suffered
in his trade and profession. Accordingly, the Amended Complaint
provides detail on those injuries as well as on other aspects of Mr.
Rather's fraud claim."
On April 10th, Judge Gammerman had ruled to dismiss portions of Dan Rather's claims;
but on April 23rd, the Judge ruled that Rather would have a chance to replead the
dismissed portions, submit an amended complaint, as well as
subpoena the investigator that CBS employed to check into the story
of President George W. Bush's military service.
"In
essence, the Amended Complaint provides specific detail in support of the
fraud claim," Dan Rather stated. "I continue to
stay focused on the big picture and look forward to getting to the
truth. We need to ensure that politics and profits don't come before
the public trust in America's
newsrooms."
